James Comey indicted for social media post deemed a threat
Former FBI Director James Comey has been indicted by the Department of Justice, marking the second attempt by the Trump administration to prosecute him. The indictment is linked to a social media post Comey shared last year, featuring seashells that spell out the numbers "86 47." The DOJ claims this post constitutes a death threat against President Trump. Acting U.S. Attorney General Todd Blanche stated, "While this case is unique and this indictment stands out because of the name of the defendant, his alleged conduct is the same kind of conduct that we will never tolerate and that we will always investigate and regularly prosecute."
The indictment includes two felony counts of threatening the president's life, which could lead to a maximum prison sentence of 10 years. A warrant for Comey's arrest has also been issued. In response, Comey stated, "Well, they're back, this time about a picture of seashells on a North Carolina beach a year ago. And this won't be the end of it. But nothing has changed with me. I'm still innocent. I'm still not afraid and I still believe in the independent federal judiciary. So let's go."
The timing of the indictment has raised questions, as the investigation has reportedly been ongoing for a year. Blanche noted that the timing was coincidental, although it coincides with President Trump's expressed frustration over the pace of prosecutions against his political adversaries. The DOJ's focus under Blanche has shifted towards perceived political enemies, including Comey, former CIA Director John Brennan, and President Joe Biden.
Prosecutors face a significant challenge in proving that Comey knowingly threatened the president, as established by a recent Supreme Court ruling requiring a subjective understanding of threats. Comey has claimed he was unaware that the phrase "86" carried violent connotations. The implications of this case could extend beyond Comey, as Blanche indicated that each case is unique, but the precedent could influence future prosecutions related to political speech.
What to watch: The upcoming legal proceedings against Comey will reveal how the DOJ navigates the complexities of free speech and perceived threats in a politically charged environment.
