Oregon court crisis leaves defendants without legal representation
Corshelle Jenkins, a 36-year-old resident of Portland, was wrongfully charged with theft due to mistaken identity and faced a warrant for her arrest. After receiving a letter in May 2025, Jenkins learned she was accused of shoplifting pink boots from Nordstrom, despite being at work during the alleged incident. When she appeared in court, a judge informed her that the state had no public defenders available to represent her, leaving her with no option but to wait for an attorney.
At that time, approximately 1,280 other defendants in Multnomah County were also waiting for legal representation, with some individuals having waited months or over a year. The Oregon Supreme Court ruled in February that charges against defendants who have waited 90 days or more for a lawyer in felony cases must be dismissed, affecting over 1,400 pending cases. However, those whose cases were dismissed could still face new charges for the same offenses.
The legal crisis in Oregon has been exacerbated by a shortage of public defenders, with the American Bar Association estimating a need for 1,300 additional full-time defenders to meet demand. The state's public defense system has struggled due to low pay, high turnover, and an influx of cases stemming from the homelessness and addiction crises. Oregon's convoluted public defense model, which relies on a mix of nonprofits and private firms, has also contributed to the lack of oversight and adequate representation.
As of May 2025, around 3,900 defendants were waiting for a lawyer, with 1,700 others unrepresented due to missed court hearings. The crisis has been brewing for years, with the pandemic further complicating the backlog of cases. Recent reforms have attempted to address the issues, but the system remains under severe strain.
